- This document (hereinafter referred to as the "Terms and Conditions"), together with other documents mentioned herein, sets forth the terms and conditions to which the use of MY BOHEMIAN SISTERS online store (operating at mybohemiansisters.com, hereinafter referred to as the "Store") is subject.

- As a Consumer, the Customer must accept the Terms and Conditions before placing an order, and once accepted, the provisions of these Terms and Conditions are binding on the order being placed. It is very important to read the Terms and Conditions and Privacy Policy each time an order is placed.

INFORMATION ABOUT US
- Sales of goods in the Store is carried out under the name "MY BOHEMIAN SISTERS" by MY BOHEMIAN SISTERS Katarzyna Caruso based in Warsaw, 30/514 Kopernika Street, 00-336 Warsaw, registered in CEIDG, REGON: 140925212, NIP: 118-175-45-70 (hereinafter: Seller or Service Provider).

IMPORTANT TERMS
- Any person (1) a natural person with full legal capacity, and in cases provided for by generally applicable laws also a natural person with limited legal capacity; (2) a legal person; or (3) an organizational unit without legal personality, which is granted legal capacity by law, using our Store and placing an order to conclude an Agreement with the Seller is referred to as the "Customer" for the purposes of these Terms and Conditions.
- A customer may also be a "Consumer" if he or she is an individual who uses the Store and makes a purchase on it that is not directly related to his or her business or professional activity.
- Within the meaning of these Terms and Conditions, a Customer is (1) a natural person with full legal capacity, and in cases provided by generally applicable laws, also a natural person with limited legal capacity; (2) a legal person; or (3) an organizational unit without legal personality, which is granted legal capacity by law; - using or intending to use the Electronic Service.
- The contract for the purchase of Products through the Store between us and you will be hereinafter referred to as the "Contract".
- "Products" means the goods available in the Store, which are the subject of the Contract between the Customer and the Seller.
- The "Price" shall mean the gross price of the Product placed next to the information about the Product, expressed in Polish zloty, including the Product delivery costs. Whereas "Product Delivery Costs" - are the charges for delivery of the Product to the Customer in Poland.
- The Order - a declaration of will of the Customer made via the Order Form and aimed directly at concluding a Contract with the Seller.
INFORMATION ABOUT CUSTOMERS AND THEIR VISITS TO THE STORE
- The administrator of personal data processed in the Store in connection with the implementation of the provisions of these Regulations is the Seller. Personal data are processed for the purposes, for the period and based on the grounds and principles indicated in the Privacy Policy published on the Store's website. The Privacy Policy contains, first of all, the principles concerning the Administrator's processing of personal data in the Store, including the grounds, purposes and period of processing personal data and the rights of data subjects, as well as information on the use of cookies and analytical tools in the Store.
- Use of the Store, including making purchases, is voluntary. Similarly, the related provision of personal data by the Customer using the Store is voluntary, subject to the exceptions indicated in the Privacy Policy (conclusion of a contract and statutory obligations of the Seller).
- By making a purchase in the Store, the Customer consents to the collection and processing by the Seller of the personal data provided in the form within the meaning of the Act of August 29, 1997 on the protection of personal data (Journal of Laws of 2016, item 926) for the purpose of carrying out Orders made in the Store.
- The Customer may consent to receive advertising and commercial information from the Seller, including by means of electronic communication. This consent is given by the Customer by marking the appropriate option on the registration form. The consent is not a condition for the execution of the Order.
USE OF OUR STORE
- When using the Store and placing orders through it, the Customer agrees to:
- Use the Store only for relevant inquiries and legally binding orders;
- Not to place false or fraudulent orders. If we suspect that such an order has been placed (e.g., in the case of a stolen credit card or similar case), we will try, to the extent possible, to contact the Customer to verify the veracity of the above suspicions, depending on the contact information we have, and if the above suspicions are confirmed, we have the right to cancel the order and notify the Customer of the situation;
- Provide us with your email and mailing address and/or other contact information.
- If the Customer does not provide us with all the required information, he will not be able to place an order.
- By placing an order in the Store, the Consumer declares that he is of legal age and/or has full legal capacity (to enter into Contracts).
- The information provided on the Store website does not constitute an offer within the meaning of the Civil Code. They constitute an invitation to submit offers by Customers.
E-SERVICES
- The following E- Services are available in the Store: Order Form and Newsletter.
- In the Order Form, it is necessary for the Customer to provide the following data concerning the Customer: name and surname/company name, address (street, house/apartment number, postal code, city, country), e-mail address, contact telephone number and data concerning the Contract: Product(s), quantity of Product(s), place and method of delivery of Product(s), method of payment. It is also possible at this stage to indicate comments on the customization of the Product for the Customer ("Personalized Product").
- The Order Form E- Service is provided free of charge and has a one-time nature and is terminated when the Order is placed through it or when the Customer discontinues placing the Order through it earlier.
- If the Customer decides to subscribe to the Newsletter, the Seller also provides the Customer with an Electronic Service consisting of sending the Customer e-mails containing information about news, promotions, products or services of the Seller. Subscribing to the newsletter is done by completing and submitting the newsletter subscription form or by checking the appropriate checkbox in the ordering process.
- The Newsletter E- Service is provided free of charge for an indefinite period of time. The Customer has the opportunity, at any time and without giving any reason, to unsubscribe from the Newsletter (Newsletter cancellation) by sending an appropriate request to the Service Provider, in particular via e-mail to the address: e-mail or in writing to the address of the Seller's registered office given in these Terms and Conditions.
- Technical requirements necessary for cooperation with the information and communication system used by the Service Provider: (1) computer, laptop or other multimedia device with access to the Internet; (2) access to electronic mail; (3) updated web browser: Mozilla Firefox version 17.0 and higher or Internet Explorer version 10.0 and higher, Opera version 12.0 and higher, Google Chrome version 23.0. and higher, Safari version 5.0 and higher, Microsoft Edge version 25.10586.0.0 and higher; (4) recommended minimum screen resolution: 1024x768.
HOW TO PLACE AN ORDER
- In order to place an order (hereinafter referred to as "Order"), the Customer must go through the entire online purchase procedure at mybohemiansisters.com, i.e. add the selected Product(s) to the shopping cart, complete the required address information in the Order Form, and then proceed to payment and click the "I Order and Pay" button.
- In the course of placing an Order, but before making payment (clicking on the "Order and pay" button), the Customer may change the details of the Order.
- The order shall be deemed to have been placed after proper payment.
- After placing your order, you will receive an e-mail from us confirming that we have received your order (hereinafter referred to as the "Order Confirmation"). The Order Confirmation e-mail does not signify our acceptance of the order; it simply signifies our confirmation that we have received the Customer's order.
- Within 48 hours after the Customer places an order, the Store will process the order. Once the order has been processed and ordered (sewing of your kimono), the Customer will receive an e-mail regarding the acceptance of the order and the start of the order processing (hereinafter: "Order Acceptance").
- When the product is ready for shipment, you will receive an email that will contain the shipping details ("Shipping Confirmation"). When we send and the Customer receives the Shipping Confirmation, a Contract is concluded between us and the Customer.
- The lead time indicated in the Product description in the Store is calculated from the moment of Order Confirmation to the moment we send the shipment to the Customer and is from 7 to 21 days, unless a different period is indicated in the Product description on the Store website.
PRICE AND PAYMENT
1. Prices listed on the Store are gross prices. Prices include shipping fee.
2. Prices are subject to change at any time. However, price changes do not apply to orders already placed. In case of introduction and cancellation of promotional actions, discounts do not combine with other promotional actions and sales.
3. The entity providing online payment services is Blue Media S.A., based in Sopot.

5. The store shall refund the payment using the same method of payment used by the consumer, unless the consumer has expressly agreed to a different method of refund that does not incur any costs for the consumer.

MODIFICATION OF THE ORDER BEFORE THE START OF ITS IMPLEMENTATION
- The store does not guarantee the possibility of modifying the Order at any stage of preparing the Order.
- In the case of confirmation of the possibility of modification of the submitted Order, the e-mail addressed to the Customer in this regard will constitute a Confirmation of the Order after changes.
UNAVAILABILITY OF PRODUCTS
1. In exceptional situations it may not be possible to process the Order. In such a case, the Store will immediately, but no later than 72 hours after Order Confirmation, inform the Customer by e-mail indicating the need to remove this item from the order before further processing of the order.1. 2. In the absence of an email response from the Customer within 48 hours of receipt of the information referred to in paragraph 1 above, the Store shall have the right to remove the unavailable product from the Order on its own and to process the order for the remainder in accordance with the Order Acceptance sent thereafter
3. The price for an unavailable Product shall be refunded to the Customer by the Store within 14 days from the date of informing the Customer of the unavailability of the Product in question.
DELIVERY
- Delivery of the ordered Products is carried out on the territory of Poland by sending the ordered Products to the address indicated by the Customer through available shipping services (carriers/couriers). The Customer chooses the delivery method when placing an order.
- We will deliver the Product(s) in accordance with the email Confirmation of Dispatch of the Order and at the date indicated therein or, if no delivery date is indicated, within the approximate time frame indicated in the selection of the type of delivery, and in any event within a period not exceeding 30 days from the date of the Agreement.
- The customer is asked to check the condition of the shipment upon receipt. In the event of loss or damage to the item, the Customer is asked to perform all actions necessary to determine the liability of the carrier informing the Store of this fact: writing a protocol specifying the condition of the shipment and the circumstances under which the damage occurred and signed simultaneously by the carrier and the recipient of the shipment.
- For the purposes of these Terms and Conditions, a "delivery" shall be deemed to have been made or an order "delivered" when the Customer or a third party designated by the Customer actually comes into possession of the product.
- Please note that we do not make deliveries to PO Box addresses, student homes or hotels. Please also note that we do not make deliveries to customer's residence on Saturdays, Sundays and holidays.
- The store does not offer the possibility of personal collection of ordered Products.
- If you wish to order Products with delivery to another country of the European Union, please contact the Store to place an order by e-mail and determine the cost of delivery. At the same time the Store reserves the right to refuse orders with delivery outside Poland without giving any reason.
TRANSITION OF RISK AND OWNERSHIP OF PRODUCTS
Upon delivery, the Customer shall be responsible for the risk associated with the Product. The Customer will take full possession of the Products upon delivery.
PURCHASE PRODUCTS AS A GUEST
In our Store, Users purchase goods as guests, i.e. unregistered Customers. For this type of purchase, we ask the Customer to provide the basic data necessary to process the order. In order to manage a given order, an unregistered Customer can access it through a link sent in the Order Confirmation.
WITHDRAWAL

- In order to exercise the right to withdraw from the Contract, the Consumer should notify us by postal mail or e-mail at: kasia@mybohemiansisters.com or using our Return Form to withdraw from this Contract. Providing a reason for withdrawal is not required. We encourage you to use the Model Withdrawal Form provided in the Appendix to these Terms and Conditions, but it is not mandatory.
- The consumer shall not have the right to withdraw from the Contract if its subject is the supply of one of the following products:
- Personalized Products, that is, products that have been customized to meet the individual needs of the customer;
- Goods in sealed packaging, which cannot be returned after opening the package for health or hygiene reasons, if the package was opened after delivery.

- In the event of a statutory withdrawal from this Agreement by the Consumer, we will return all payments received from the Consumer, including shipping costs, using the same payment method that the Consumer chose when paying for the product, unless the Consumer has expressly agreed to a different refund method, which does not generate any additional costs for the Consumer.
- In the case of statutory withdrawal from this Agreement, the refund of the Price will be made without undue delay, and in any case no later than within 14 days from the date on which the Store receives the returned Products.
- Returned Product(s), should be delivered in original packaging, to the Seller (shipment to the address specified in the Model withdrawal form by courier - through a shipping company or parcel through the Polish Post) no later than 14 days from the day on which the Consumer informed the Seller about the withdrawal from the Agreement. The deadline is met if the Consumer sends the Product(s) before the expiration of 14 days.7. - It is the responsibility of the Consumer to properly secure the returned Products before shipment to prevent damage or destruction in delivery.
- The consumer will bear the direct costs of returning the products.
- The consumer shall be liable for any diminution in the value of the goods resulting from their use beyond what is necessary to establish their nature, characteristics and functioning.
PRODUCT DEFECT WARRANTY
- The store shall be liable for defects in the Products, subject to the following provisions, in accordance with the applicable statutory provisions, in particular in accordance with Article 566 et seq. of the Civil Code.
- A product is defective if: (i) it does not have the characteristics that such thing should have in connection with the purpose provided for in the Contract or arising from the circumstances or in connection with its intended use, (ii) it does not have the characteristics that the seller assured the buyer of, in particular by presenting the buyer with a sample or model, (iii) it is not intended for the purpose indicated by the seller to the buyer at the time of the conclusion of the Contract and the Store has not made a reservation as to its intended use, and (iv) it has been delivered to the buyer incomplete.
- Products offered in the Store are artisanal and artistic products, which often have the characteristics of natural raw materials used in their manufacture. We select only the highest quality products, but some characteristics are unavoidable. These characteristics, such as differences in grain, texture, knots and color, may cause some slight differences in the finish of the products. With the above in mind, however, we confirm that nothing in this paragraph will affect your statutory rights under warranty or contractual right of withdrawal.3. Products offered in the Store are artisanal and artistic products, which often have the characteristics of natural raw materials used in their manufacture. We select only the highest quality products, but some characteristics are unavoidable. These characteristics, such as differences in grain, texture, knots and color, may cause some slight differences in the finish of the products. - The Consumer is granted a warranty for a period of two years. The warranty period begins when the Product is delivered to the Consumer. With respect to other Customers who are not Consumers, the warranty for defects is excluded
- The store shall not be liable for defects in the delivered goods if they are caused as a result of improper use of the goods by the Customer or making changes to the goods in a manner to which the store does not agree. This also applies to situations where the Customer has not followed the regulations on the handling and care of the goods (such as washing and drying instructions).
- Consumers have the right to free repair or replacement, price reduction or return of the product if it is defective. These rights apply to defects that occurred within 2 years from the date of delivery of the product(s). It is not necessary to present a receipt. The condition for preserving the right to exercise the claim is to notify the defect immediately after its discovery.
- It is recommended that the Customer provide in the description of the complaint: (1) information and circumstances regarding the subject of the complaint, in particular the type and date of occurrence of the defect; (2) a request for the method of bringing the Product into conformity with the Contract or a statement of price reduction or withdrawal from the Contract; and (3) contact details of the complainant - this will facilitate and accelerate the processing of the complaint by the Seller. The requirements specified in the preceding sentence are in the form of a recommendation only and do not affect the effectiveness of complaints submitted with the omission of the recommended description of the complaint.
- To file a complaint, we encourage you to use the form available at: __________________________ or send the information specified therein - directly to our email address.
- Within the aforementioned period, the Consumer may, instead of the defect removal proposed by us, demand the replacement of the thing with a defect-free product (if available) or, instead of replacing the thing, demand the removal of the defect, unless bringing the thing into conformity with the Agreement in the manner chosen by the Consumer is impossible or would require excessive costs in comparison with the manner proposed by us. In assessing the unreasonableness of costs, the value of the defect-free product, the nature and significance of the defect found, and the inconvenience to which other means of satisfaction would expose the Consumer shall be taken into account.
- We will consider the complaint immediately, but no later than within 14 days from the date of delivery of the advertised Product with a description of the defect (we recommend filling out a complaint form). The Consumer should send the Product that is the subject of the complaint to the Seller's registered office within 14 days from the date of disclosure of the defect according to the rules as in item. 13 paragraph 7 of the Regulations.10. - If the Customer, who is a consumer, has requested replacement of the item or removal of the defect, or has made a statement on price reduction, specifying the amount by which the price is to be reduced, and the Seller has not responded to this request within 14 calendar days, it is considered that the request has been recognized as justified.
- The Customer who exercises warranty rights is obliged to deliver the defective Product to the address of the Seller. In the case of a Customer who is a consumer, the cost of delivery of the Product shall be borne by the Seller, in the case of a Customer who is not a consumer, the cost of delivery shall be borne by the Customer.

- We will refund the Price using the same method of payment that the Consumer has chosen when paying for the product, unless he or she has expressly indicated a different method of refund and as long as it is technically possible, which does not generate any additional costs for the Consumer.
OUT-OF-COURT PROCEDURES FOR HANDLING COMPLAINTS AND INVESTIGATING CLAIMS, AS WELL AS RULES OF ACCESS TO THESE PROCEDURES
- Detailed information on the possibility for a Customer who is a consumer to use out-of-court procedures for handling complaints and pursuing claims, as well as the rules of access to these procedures, is available on the website of the Office of Competition and Consumer Protection at: https://uokik.gov.pl/pozasadowe_rozwiazywanie_sporow_konsumenckich.php.
- There is also a contact point at the President of the Office of Competition and Consumer Protection (telephone: 22 55 60 333, email: kontakt.adr@uokik.gov.pl or written address: Pl. Powstańców Warszawy 1, 00-030 Warsaw.), whose task is, among other things, to provide assistance to consumers in matters concerning out-of-court settlement of consumer disputes.
- The consumer has the following examples of out-of-court means of handling complaints and pursuing claims: (1) a request for dispute resolution to a permanent amicable consumer court (for more information, see: http://www.spsk.wiih.org.pl/); (2) a request for out-of-court dispute resolution to a provincial inspector of the Commercial Inspection (for more information, see the website of the inspector in charge of the Seller's place of business); and (3) the assistance of a district (city) consumer ombudsman or a social organization whose statutory tasks include consumer protection (e.g., Federation of Consumers, Association of Polish Consumers). Advice is provided, among other things, by e-mail at porady@dlakonsumentow.pl and at the consumer hotline number 801 440 220 (hotline open on Business Days, from 8:00 am to 6:00 pm, call charge at the operator's tariff).
- There is a platform for online dispute resolution between consumers and businesses at the EU level (ODR platform) at http://ec.europa.eu/consumers/odrdostępna. The ODR platform is an interactive and multilingual website with a one-stop shop for consumers and businesses seeking out-of-court resolution of disputes regarding contractual obligations arising from an online sales or service contract (for more information, visit the platform itself or the Office of Competition and Consumer Protection's website address: https://uokik.gov.pl/spory_konsumenckie_faq_platforma_odr.php).
RIGHT OF WITHDRAWAL AND RETURN FOR ORDERS FROM ABROAD
Please be advised that under no circumstances shall the Store be obligated to pay shipping costs to destinations other than the original delivery address, or return costs from destinations outside of Poland.
NOTICES
When making requests sent to us by the customer, it is recommended primarily to use contact through adequate forms or a message sent to our e-mail address (the "Contact" tab at www.mybohemiansisters.com). Each person who sends us a message thereby consents to the processing of his/her personal data under the terms of the Privacy Policy.
PARTIAL CANCELLATION
If one of the provisions of these Terms and Conditions or the provisions of the Agreement is declared invalid by a final decision of a competent public administration body or a final judgment of a common court, the remaining terms and conditions shall remain in force, and the said declaration of invalidity shall not apply to them.
OUR RIGHT TO CHANGE THESE REGULATIONS
The customer must comply with the Privacy Policy and Terms and Conditions in effect at the time he/she uses the Store and/or places an order, except when, by law or decision of public administration or local government bodies, we are required to make retroactive changes to the said Privacy Policy, Terms and Conditions. However, these changes will not apply to orders already placed.
JURISDICTION
Any disputes arising out of the use of www.mybohemiansisters.com or the Agreement or other matters related thereto shall be subject to the jurisdiction of Polish courts and Polish law.

FINAL PROVISIONS
- The Seller hereby instructs the Customer that the content contained in the Store, digital content available, textual, graphic and photographic materials and Products are protected by copyright, and the copyright belongs to the Seller.
- Unlawful distribution of content or materials referred to in paragraph 1 above may result in civil or criminal liability.
- The Regulations shall come into force on 01.11.2021.
